1. Who we are

“Fadercraft” is the trading name of an independent sole trader based in Thailand. In these terms, “Fadercraft”, “we”, “us”, and “our” refer to that sole trader. You can reach us at hello@fadercraft.com.

“You” means the person who buys or uses our software.

2. Merchant of record

All purchases on this site are processed by Paddle.com Inc. and its affiliates (“Paddle”), which acts as the merchant of record for every transaction. Paddle handles payment processing, billing, sales tax and VAT, invoicing, refunds, and chargebacks. When you buy a Fadercraft product you also agree to Paddle’s buyer terms, available at paddle.com/legal/checkout-buyer-terms.

3. Licence

When you buy a Fadercraft product we grant you a non-exclusive, non-transferable, perpetual licence to use that product, in the version sold, on devices you own or control. The licence is for a single individual user. If you bought the product on behalf of your employer or client, that organisation shares the same licence with you for the same single-user scope.

You may install the product on as many machines as you personally use. You may make backup copies. You may not share, resell, sub-licence, redistribute, or publish the product or any part of it.

4. Intellectual property

All Fadercraft products, including the Max for Live devices, JavaScript files, Ableton Live Sets, custom modes, documentation, audio content, and visual assets, are the intellectual property of Fadercraft or its licensors. The licence in section 3 does not transfer ownership; it gives you the right to use the product as described.

Music and other creative work you make using a Fadercraft product belongs entirely to you. We claim no rights over your output.

5. Permitted use

You may use Fadercraft products for any lawful purpose, including commercial production and live performance. You may not attempt to reverse-engineer, decompile, or extract the source of compiled components, except to the extent that local law expressly permits.

6. Updates

We may publish updates to a product. Updates within the same major version are included in your licence at no extra cost. A future major version may be sold as a separate upgrade.

7. Warranty disclaimer

Our products are provided “as is”. We test them carefully, but we cannot guarantee they will be free of bugs or compatible with every version of every host application or operating system. Where local law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Nothing in these terms limits any non-waivable consumer rights you have under local law.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to a Fadercraft product is limited to the amount you actually paid for that product in the twelve months before the claim. We are not liable for indirect, incidental, special, or consequential damages, lost profits, or lost data. Nothing here excludes liability for fraud, death, or personal injury caused by negligence, where local law forbids such exclusion.

9. Refunds

Refunds are governed by our Refund Policy and processed by Paddle. Please read both documents together.

10. Changes to these terms

We may update these terms from time to time. The current version is always at this URL with a “Last updated” date at the top. If we make a material change we will note it on the home page for at least thirty days. Your continued use of a Fadercraft product after the change means you accept the new terms.

11. Termination

The licence ends automatically if you breach these terms in a material way, for example by redistributing the product. On termination, you must stop using the product and delete your copies.

12. Governing law

These terms are governed by the laws of England and Wales. Any dispute that cannot be resolved informally will be brought before the courts of England and Wales. This choice does not deprive you of any protection you have under the mandatory consumer law of the country where you live.
